Fair to sack manager with "inability to take responsibility" for his actions

The way a manager responded to misconduct allegations gave his employer "no reason to hope" he would comply with its code of conduct in future, a commission has found in rejecting his unfair dismissal claim.

The substantiated allegations amounted to serious breaches of the code, while the manager's response revealed "an inability to take responsibility and a lack of insight on his part", Western Australian Industrial Relations Commission Senior Commissioner Rachel Cosentino said.

She heard the Shire of Morawa hired the manager of corporate systems and performance in June 2024 to build a positive team environment, after it realised it needed to address a "toxic work environment problem".
