The fact that an employee's false bullying allegations against a colleague were just "bluff and bluster" made in the "heat of battle" didn't excuse his conduct, the Fair Work Commission has found in upholding his dismissal.
Commissioner Phillip Ryan found the employee's behaviour towards the colleague was "unreasonable and intimidatory, and constituted harassment".
In October last year, Transit Systems sacked the bus driver for misconduct, after an investigation found he had acted aggressively during a meeting and unlawfully disclosed personal information about the colleague "to promote [his] personal ambitions"...
