An employee who called his colleague a "fat exploiter of foreigners" was fairly dismissed despite a "clearly deficient" termination process, the Fair Work Commission has ruled.
Vivesco sacked the gardener in February this year for breaching its workplace harassment and bullying policy, after it received multiple complaints from colleagues about his allegedly aggressive and erratic behaviour.
In unfair dismissal proceedings, the Commission heard many colleagues had asked not to be rostered to work with the employee, and one staff member took leave to get away from him.
On one occasion, the employee called a colleague a "liar" and shouted that he was a "fat exploiter of foreigners", during a dispute about a lawnmower...
