Frustrated employer 'exaggerated' absent manager's failings

The "primary motivator" for an absent manager's dismissal was his employer's belief he was falsifying his illness, the Fair Work Commission has ruled in upholding his unfair dismissal claim.

Commissioner Benjamin Redford rejected that the operations manager had "refused to engage" with CSC Waste & Recycling while he was unwell, describing the employer's claim that he failed to communicate as an "overstatement".

In August last year, the operations manager took sick leave and provided a medical certificate that stated he would be unfit for work for five days due to a "medical condition"...
