The fact an employee might be reinstated to the organisation against which she sought stop-bullying orders wasn't enough to overcome a jurisdictional objection to her claim.
Considering the threshold matter of whether the employee remained at risk of bullying while not employed, Commissioner Emma Thornton said she was unable to conclude her potential reinstatement was "anything more than aspirational or speculative".
