FWC disagrees "it takes two to tango", upholding harasser's dismissal

An employee who "relentlessly pursued" a subordinate despite her repeated rejections has lost his unfair dismissal claim, with the Fair Work Commission finding his behaviour amounted to serious misconduct.

Commissioner Tim Lee found the University of Tasmania lecturer and lead researcher displayed a "level of delusion" about his conduct that made it "unsafe" for him to ever work closely with students or staff in the future.

He said the employee failed to accept accountability for his actions towards the female research assistant and attempted to "dishonestly 're-characterise' the nature and context of his interactions to exculpate himself"...
