The Fair Work Commission has clarified the extent of some of its powers regarding s-xual harassment allegations that traverse the period before and after relevant amendments to the Fair Work Act.
The alleged behaviour occurred for four years until May 2024, but because it formed part of a course of conduct that started before 2023's Secure Jobs, Better Pay amendments, the Commission had no jurisdiction to deal with the employee's specific dispute, Commissioner Sarah McKinnon found.
