A senior HR business partner's "patently false", "unsubstantiated" and at times "misogynistic" claims have undermined his unfair dismissal case, the Fair Work Commission has chastised.
Acknowledging there were procedural flaws in the employer's disciplinary process, Deputy President Ian Masson nonetheless found these were "comfortably outweighed" by the gravity of the HRBP's serious misconduct.
In unfair dismissal proceedings, Stantec Australia said numerous instances of misconduct meant it had valid reasons to sack the HRBP in March this year.
These included: his "unrelenting coercive control and predatory sexual behaviour" towards female workers; his attempt to contact one of them after she complained about him; and his doctoring a text message so it appeared to show a colleague apologising for making her own allegations...
