An employee breached s-xual harassment laws when she sent 15 images to a coworker, who had "reluctantly agreed" to receive just one, the Federal Court has found.
The images "all appear to be intended to be humorous", Justice Geoffrey Kennett accepted, but he found they were unwelcome conduct of a sexual nature, and a reasonable person would have anticipated that the coworker might be offended, humiliated or intimidated by them.
This case has a "long and troubled history", Justice Kennett observed.
