An employer didn't discriminate against an employee on the basis of his race when it told him he had to adhere to his roster, while simultaneously approving a co-worker's amendment request, a tribunal has found.
The two employees' circumstances couldn't be compared and the decision wasn't motivated by race, age or sex, NSW Civil and Administrative Tribunal Senior Member Joanne Little and General Member Maryanne Maher said.
They also rejected the employee's claims that his manager racially vilified him, preferring the manager's evidence that he never made any reference to the employee's race.
