"Lack of urgency" in applying for extension undermines employee's appeal

A finding that an employee "acted with a lack of urgency" to ensure he maintained legal working rights was open to the Fair Work Commission, a full bench has confirmed in rejecting his unfair dismissal appeal.

The Costco inventory control specialist appealed against a February decision, in which Deputy President Bryce Cross found the expiry of his bridging visa gave his employer a valid reason to sack him (read HR Daily's report of the case here).

In the earlier proceedings, Deputy President Cross heard that on 6 August 2024, the employer requested updated details of the employee's visa, which was due to expire a week later. Despite telling the employer he expected his new visa to arrive soon, he hadn't yet applied to renew it, and did so the next day...
