Long-serving manager's "shocking" redundancy caused psychological injury

Despite receiving HR advice about how to handle a redundancy meeting, an employer gave a long-serving manager no prior notice of its decision and no opportunity to bring a support person, among other factors found to be unreasonable.

Acknowledging the employer's need to restructure, NSW Personal Injury Commission Senior Member Kerry Haddock nonetheless said this had to be weighed against the manager's rights.

She heard that shortly after receiving news of his redundancy in March last year, the New Evolution Ventures Australia finance manager claimed workers' compensation for depression and anxiety.

The employer, however, disputed liability on the basis his injury was caused by reasonable action with respect to retrenchment...
