It was fair to sack an employee who showed up to work at the wrong time, the Fair Work Commission has found, even though the employer should have discussed its change to his regular shift.
Commissioner Stephen Crawford said he came "very close" to finding the dismissal was harsh, noting the "lower-level severity" of the employee's conduct, but ultimately decided he was fairly sacked.
The casual employee worked for Aspire Community Solutions, providing disability and mental health support to participants in the NDIS.
