Management had "room to improve", but actions weren't bullying

An employer had "room to improve" certain communication and processes, but the issues an employee complained about didn't warrant stop-bullying orders, according to the Fair Work Commission.

The casual enrolled nurse complained she had been bullied by Bupa Aged Care Australia and the general manager of Bupa Berwick, starting in June 2023 when she raised concerns about workload and staff shortages.

On that day, when the employee asked the GM about the lack of staffing on a shift, she said the GM's response was: "You guys are wasting time here. What are you doing here? You should be going on the floor and doing some work."

This was "rude and inappropriate" and constituted bullying, the employee said, noting she felt "humiliated and intimidated" in front of other people...
