When a manager discussed an employee's pregnancy with her colleagues without her consent she wasn't left with no choice but to resign, the Fair Work Commission has found, in dismissing her general protections claim.
The employee's early pregnancy disclosure to her manager should have caused him to "keep it to himself", Commissioner Damian Sloan said, but he found the manager's conduct wasn't intended to bring her employment to an end.
In October 2025, the employee informed her employer, software company Zitcha, that she was six weeks pregnant.
She told the co-founders, one of whom was her manager, that she was sharing the news "early" because she might need to take time off work with little notice, due to her history of suffering from Hyperemesis Gravidarum (severe nausea and vomiting) during pregnancy...
