Manager's responses to "most difficult of circumstances" were reasonable

The Fair Work Commission has refused an employee's application for stop-bullying orders, while finding some of his own behaviour was "consistent with upward bullying".

The employee repeatedly refused to comply with the manager's directions, questioned "every decision he made" and persistently undermined his authority, while the manager's actions were at all times reasonable, Commissioner Katrina Harper-Greenwell found.

In seeking stop-bullying orders, the Xin Jin Shan Chinese Language and Culture School employee claimed his manager (the school principal), among other things: denied him access to retrospective leave for a public holiday; deprived him of his contractual rights in not allowing him to manage staff attendance; and set up a "comprehensive and malicious trap" to remove him from the school...
