A colleague's resignation threat was the "main driver" of an employee's dismissal, the Fair Work Commission has found in awarding him maximum compensation.
Deputy President Nicholas Lake found Modcon Group demonstrated "a lack of common courtesy or respect" when it "sprung" the dismissal on the construction manager.
He said if the employer had genuine issues with the manager's interactions with colleagues and external parties, then it could have undertaken a "more formal process", although his conduct still wouldn't have warranted summary dismissal...
