Failing to update workplace policies was a "significant dereliction" of a manager's duty, but his employer's investigation flaws made his dismissal harsh, the Fair Work Commission has ruled.
Deputy President Peter O'Keeffe found the Leaning Tree Steiner School education manager failed to protect the employer by introducing a policy to ensure all employees – including himself – were aware of changes in the way schools were required to deal with allegations of misconduct towards children.
