The Fair Work Commission has sided with an employer that sought to reduce the time an employee worked from home, saying it's expected that management will "take reasonable measures to ensure that staff are providing the value for which they are paid".
The Commission was hearing an unfair dismissal application from an architectural draughtsperson. He claimed he was constructively dismissed, saying he had "no choice but to resign" following a meeting with management over his WFH arrangements and performance.
The employer – architecture firm Archsign – objected to the claim on the basis the employee resigned voluntarily.
The employee claimed he was called into a meeting with the company's operations manager, following confusion over whether he was working in the office or from home on 9 September last year...
