Neglecting critical task despite warning and PIP warranted dismissal

After already receiving a final warning and being placed on a performance improvement plan, an employee's failure to complete a crucial task made his dismissal valid and fair, according to the Fair Work Commission.

"It is unclear why [the employee] did not learn from the first incident and chose to deviate from his PIP; other than he simply did not think it was necessary," Commissioner Pearl Lim said.

Roy Hill Holdings sacked the maintainer fitter in May 2025 for failing to conduct a job hazard analysis or perform other safety-critical tasks before starting a job.

He claimed his dismissal was unfair, but the employer said its decision was warranted because it had already given the employee a formal warning and placed him on a performance improvement plan following a prior incident...
