New rights set to create more "adversarial" workplaces

New delegates' rights could lead to an uptick in general protections claims and more "adversarial" relationships with employees, so it's important for employers to get up to speed on the changes quickly, a workplace lawyer warns.

As part of the Closing Loopholes legislation, new delegates' rights took effect in December last year and from 1 July this year, all enterprise agreements and modern awards must include a delegates' rights term.

From 26 August, new rights will extend to the regulated workers space, which includes digital platform workers – the Fair Work Ombudsman has published new fact sheets on delegates' rights and right of entry...
