"One-off" record-keeping breach didn't warrant dismissal

An employer must reinstate an employee it accused of time theft and safety breaches, after the FWC found his allegedly serious misconduct either didn't occur, or was a "one-off record keeping breach".

The employee's conduct didn't warrant dismissal, Deputy President Alexandra Grayson found.

"At most, I consider that some targeted training or counselling... would have been warranted," she said.

The concrete truck driver was dismissed for serious misconduct by Heidelberg Materials Australia Pty Ltd in November 2025...
