The operational variations between 10 employers weren't "significantly" different enough to warrant blocking a supported bargaining authorisation, a Fair Work Commission full bench has ruled.
Deputy President Judith Wright and Commissioners Leyla Yilmaz and Susie Allison said this was not a case where the different characteristics of each employer meant it was unlikely an agreement would meet their respective needs.
In November 2023, following the Secure Jobs Act's multi-employer bargaining changes, the Australian Education Union and Health and Community Services Union applied for the authorisation, under section 242(1) of the Fair Work Act.
They said the relevant employers had "several" common interests, and that an authorisation would promote job security and gender equality...
