A manager "misconceived" a reduction in her duties in a negative light when in fact her employer was offering support to overcome challenges in her role, the Fair Work Commission has found in constructive dismissal proceedings.
The Hydrera Water Services quality, health, safety, and environment manager made a general protections claim involving dismissal, but the employer objected on the basis she voluntarily resigned.
The Commission heard that in October last year, the employer approved the manager's proposal to introduce a new WHS compliance monitoring system. The manager started implementing it, but said she faced issues getting the assistance she needed from key stakeholders with subject matter expertise.
In January this year the employer rated the manager's performance as "outstanding", however the employment relationship soon soured...
