P&C team's consultation failures meant redundancy wasn't genuine

A people and culture team "singularly failed" to meet with an employee in a timely manner to discuss his redeployment opportunities, meaning his redundancy wasn't genuine, the Fair Work Commission has ruled.

The team also failed to comply with "significant elements" of its own redundancy and redeployment (R&R) policy, which Deputy President Ian Masson found were "expressed very broadly".

The Triple Zero Victoria senior trainer claimed unfair dismissal after his employment ended in October last year, but the employer raised a jurisdictional objection, arguing his role was no longer required.

The Commission heard that in late May, the employer's executive director of people and culture notified all staff within the P&C team that an upcoming restructure of the function would begin the following week...
