An employer had "every right" to sack a worker who refused to update her training, but it chose not to do so, the Fair Work Commission has found in rejecting her unfair dismissal claim.
In May this year, Delmont Private Hospital's HR manager emailed the employee to say she hadn't completed some mandatory training modules, which were significantly overdue.
The email stated the training was a necessary requirement of the employee's role as a nurse at the hospital, and that if she did not complete the modules she would be temporarily removed from the roster.
The employee didn't reply, however, and the HR manager sent another message in similar terms, extending her deadline to complete the training...
