Post-employment conduct indicated dismissal, not resignation

Sending a boss a text message that said "good luck doing it by yourself" wasn't a resignation, the Fair Work Commission has found.

In unfair dismissal proceedings, Deputy President Lyndall Dean heard that in 2023, shortly after the employee started working as operations director for Intentional Care, its owner agreed that they would become business partners.

An accountant provided advice on how to structure a company and form a partnership, however there were insufficient funds in the business at the time. The employee agreed he would work at a lower rate of pay in the interim, but he said that each time it appeared the business had enough money, the funds would "disappear" from the account, withdrawn by the owner...
