Process followed in serious misconduct dismissal was "manifestly inadequate"

It was unfair to summarily dismiss an employee who had a "genuine misunderstanding" of what his employer required, regardless of his serious misconduct, according to the Fair Work Commission.

The employer had imposed terms that were "not as clear as they could have been", and appeared to have "conflicting requirements", Deputy President Thomas Roberts found. Further, its dismissal decision was presented as "a fait accompli" in a car park...
