An employer's decision not to offer an employee a new fixed-term contract after she disclosed she was pregnant did not amount to discrimination, a tribunal has found.
The Legal Aid Commission of NSW solicitor had worked on back-to-back short-term fixed employment contracts between May 2018 and January 2020.
In November 2019, she formally told the employer she was pregnant, and in December she began a period of paid parental leave.
As she had completed more than 12 months' continuous service she was entitled to 14 weeks' paid leave, but only while she remained employed by Legal Aid. In order to receive the full 14 weeks instead of just nine, she asked the employer to offer her a new employment contract beginning in January when her current one ended...
