An employee who was sacked for misconduct has used payroll records to show his employer tolerated, or even encouraged, his behaviour.
In February 2022 the Prestia heavy vehicle driver told his supervisor he'd received an infringement notice for allegedly using a mobile phone while driving in his own time.
Prestia's director discussed the matter with the employee and, perceiving a "cavalier" attitude towards safety, stood him down with pay and gave him a show-cause notice.
The notice said the employee had also started a January shift late and, in breach of fatigue management laws, finished it even later. It said the standard response to such conduct, let alone "a pattern of escalations such as this", was termination...
