An employer and its senior leaders didn't bully an executive when they asked her repeatedly to return to the office, and started a performance improvement plan after a client complained about her, the Fair Work Commission has accepted.
The employer had been sensitive to her circumstances, but never agreed she could work remotely on a permanent basis, Commissioner Damian Sloan found.
The client executive at technology company Equifax Australasia Group Services Pty Ltd applied to the Commission for stop-bullying orders, alleging she was bullied at work from as early as 2019, shortly after she joined the organisation.
Her application named four individuals, including a senior HR business partner, as her alleged bullies, but together with the employer they maintained either that the instances complained about didn't occur, weren't bullying, or were reasonable action...
