Sacked employee's $100 million general protections claim back in play

The general protections claim of an employee seeking more than $100 million is again underway, after a full bench of the Fair Work Commission found his actions against 18 respondents shouldn't have been dismissed.

The former academic at the centre of the case was sacked on performance grounds in April this year.

He subsequently claimed his dismissal breached the FW Act's general protections provisions, specifically: sections 340, 341 and 343, for making enquiries or complaints about his workplace rights; sections 346–348 for his industrial activity; and section 351, for his "race, colour, sex, sexual orientation, gender identity, age, family/carer's responsibilities, religion, political opinion, national extraction and/or social origin".

He named his employer, Monash University, as a respondent, along with the National Tertiary Education Union (NTEU) and 17 current or former Monash employees and senior managers...
