It was "fanciful" for an HR professional to defend forwarding confidential work information to his personal email, according to the Fair Work Commission, rejecting that his dismissal "did not fit the crime".
Deputy President Bryce Cross noted it was also significant that the HR professional sent the confidential information around the time he had been accused of insubordination and aggressive behaviour.
In unfair dismissal proceedings, the Commission heard that in April last year, Bollore Logistics Australia accused the junior recruitment business partner of unacceptable behaviour and insubordination.
