An employee's "self-serving act" in forwarding work emails to her personal account after being informed of a restructure was serious misconduct and warranted her dismissal, the Fair Work Commission has ruled.
In unfair dismissal proceedings, the Commission heard the Cyrenian House employee was a part-time support worker in a therapeutic withdrawal unit, and she was also engaged as a casual night weekend supervisor.
In February this year, following a review, the employer informed the employee the unit's two part-time support worker roles would be made redundant, to be replaced by a new full-time senior support worker role...
