An employer conducted a "woefully inadequate" investigation into an employee's complaints, then unfairly sacked her after deciding it couldn't provide her with a safe workplace, the Fair Work Commission has found.
There was no valid dismissal reason related to the employee's safety; rather, its decision was based on unfounded fears that she would fabricate allegations against her colleagues, Commissioner Trevor Clarke said.
"Some of the claims in the show cause letter provided to the [employee]... were, frankly, outrageous," he added.
The employee had worked for Crossway Baptist Church in a full-time role since 1997, but became part-time in 2023. She claimed unfair dismissal after her employment was terminated in October 2025...
