An employee was not eligible to apply for stop-bullying orders regarding behaviour that occurred while she was absent and receiving workers' compensation payments, the Fair Work Commission has ruled, in a case that a lawyer says takes a surprisingly narrow view of when someone is considered "at work".
The employee who sought the orders alleged she had been bullied by coworkers since commencing workers' compensation in February 2023.
She argued the bullying occurred in the form of other employees talking about "her WorkCover", her children, her past relationships and her family life, and constantly laughing at her...
