An employer's "textbook" performance management process has helped it defend an unfair dismissal claim, with the Fair Work Commission rejecting the employee's claims that system errors and team-wide backlogs explained his shortcomings.
The manager's documented weekly reviews made it clear that her "preferred path" was for the employee to lift his performance; she "took the role of manager seriously and worked hard and consistently throughout the PIP to... identify what needed to be done to close the gap in the [employee's] performance," Deputy President Nicholas Lake said.
