Two workers who settled unfair dismissal actions have failed to convince the Fair Work Commission their agreements didn't also prevent them from pursuing underpayment claims against their employer.
The first case involved a former Gold Leaf Restaurant employee who attended an unfair dismissal conciliation conference on 7 May this year. Later that day, he received an email from the FWC conciliator confirming that a settlement agreement had been reached, and the cooling-off period waived.
Within two hours of receiving the email, the employee complained he hadn't agreed to withdraw his FWO underpayment complaint...
