"Unilaterally" changing employment status was a dismissal

A manager was unfairly dismissed when her permanent full-time employment changed to casual without her agreement, the Fair Work Commission has found.

In late 2022, the employee signed an employment contract for a full-time supervisor role at the Diver Café in Coogee, Sydney, and she was subsequently appointed as café manager when another staff member left in May last year.

But in January, the employer told the manager via WhatsApp that her full-time employment would be converted to casual as it needed to "make changes to the café".

The manager's next pay slip recorded her as casual, although she continued to perform the same duties and receive the same weekly pay...
