An employer didn't act "with undue haste" regarding a worker whose visa renewal arrived just days after he was sacked for not having Australian work rights, the Fair Work Commission has ruled.
"Whatever delay the [employee] suffered was caused by his own inaction," said Deputy President Bryce Cross.
On 6 August last year, a Costco manager requested updated details for the employee's visa, which was due to expire on 14 August. He responded that he expected to receive the new visa within a week, and would forward a copy then.
The employee only applied to renew his visa the next day, and continued to work after it expired...
