Worker re-employed after four days didn't have "continuous" service

Despite an agreement not to pay out a worker's entitlements between the end of one contract and the start of another, his continuous service was "broken" during this four-day period, the Fair Work Commission has found.

The employer's failure to process a final termination payment did not indicate his service was continuous and unbroken, said Commissioner Chris Simpson.

The estimator started his employment with Queensland Coastal Plumbing on 10 March 2023, in a full-time ongoing position on a $110k salary.

He resigned in writing on 3 June 2024, stating his last day would be 14 June. According to a manager, the employee said he could be paid more elsewhere and had accepted a job with a different company...
